L1 โ Landlord Application: Non-payment of Rent
What follows an unresolved N4. Filing costs the landlord $186 online. A hearing is scheduled; nothing ends your tenancy until the Board orders it.
โฐ The deadlines
| Earliest filing | The day after the N4 termination date |
| Your evidence | Generally at least 7 days before the hearing |
| Last chance to void | Pay everything owed plus the landlord's filing fee before an eviction order is issued |
โ
You can make this notice disappear: Even mid-case: full payment (arrears + filing fee) before the order stops the eviction.
๐ก๏ธ Defenses & defects to check
- Dispute incorrect amounts with your own ledger and receipts
- Raise maintenance problems at the same hearing (s.82) โ rent abatements can offset arrears, but you must give advance notice of the issues you'll raise
- Ask for a payment plan โ the LTB orders them routinely
๐ก What the pros know
- Talk to Tenant Duty Counsel before your hearing โ free, at the hearing block itself.
- Attend no matter what: orders made in your absence are very hard to undo.
